Terms of Service

These Terms of Service constitute a legally binding agreement between you ("the Traveller") and Roamistan ("the Company", "we", "us"), a travel company registered and operating in Islamabad, Pakistan.

By using our website at roamistan.com, submitting a booking inquiry, or confirming a tour reservation, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

These terms apply to all tours, trekking expeditions, accommodation arrangements, and any other services offered by Roamistan.

Roamistan offers curated travel experiences across Northern Pakistan, including but not limited to:

• Group and private tours to Hunza Valley, Skardu, Fairy Meadows, Naran Kaghan, and surrounding regions
• Trekking expeditions including K2 Base Camp, Broad Peak Base Camp, and Gondogoro La
• Custom itinerary planning and fully tailored private tours
• Hotel and guesthouse accommodation arrangements
• Airport and intercity transfers within Pakistan
• Licensed local guide and porter services
• Photography tours and travel consultancy

We act as both a direct service provider and, in some cases, as an agent for third-party suppliers. We will clearly indicate when third-party suppliers are involved in your booking.

Booking Process

• A booking is confirmed only upon receipt of the required deposit and our written confirmation via email or WhatsApp
• Availability is not guaranteed until confirmation is issued
• You must provide accurate personal information at the time of booking — errors may result in additional charges
• Group bookings of 6+ people require a separate written agreement

Payment Terms

• A non-refundable deposit of 30% of the total tour cost is required to confirm your booking
• The remaining balance must be paid no later than 14 days before the tour departure date
• For bookings made within 14 days of departure, full payment is required upfront
• Prices are quoted in PKR (Pakistani Rupees) — foreign currency equivalents are indicative only
• Prices include all stated inclusions and are exclusive of personal expenses, tips, and optional activities

We understand that plans can change. Our cancellation policy is as follows:

Cancellation by Roamistan

• We reserve the right to cancel any tour due to unsafe weather conditions, natural disasters, political unrest, or insufficient group size
• In such cases, you will receive a full refund or the option to reschedule at no additional cost
• We are not liable for any consequential losses (e.g., flights, visas) in the event of a cancellation beyond our control

We strongly recommend purchasing comprehensive travel insurance that covers trip cancellation, medical emergencies, and evacuation.

Your responsibilities:

• You must be in good physical health and fitness appropriate for the chosen tour — some treks require prior high-altitude experience
• Disclose any pre-existing medical conditions, disabilities, or dietary requirements at the time of booking
• Obtain all required travel documents, including a valid Pakistani visa (if applicable), and ensure they are current
• Carry adequate travel insurance covering medical emergencies, high-altitude evacuation, and trip cancellation
• Follow all safety instructions given by Roamistan guides at all times

Our commitments:

• All guides hold valid Wilderness First Aid and Mountain Rescue certifications
• Emergency evacuation plans are established for all remote trek routes
• Safety equipment including first aid kits, satellite communication, and emergency oxygen is carried on high-altitude expeditions
• We reserve the right to remove any traveller from a tour who poses a safety risk to themselves or others

Travel in Northern Pakistan involves inherent risks including altitude sickness, unpredictable weather, remote terrain, and limited medical facilities. By booking with Roamistan, you acknowledge these risks and agree to the following:

• Roamistan is not liable for injuries, illness, death, loss of property, or damage arising from participation in our tours
• We are not responsible for delays, changes, or cancellations caused by force majeure events including natural disasters, pandemics, war, or government restrictions
• Our liability for any claim shall not exceed the total price paid by you for the affected tour
• We are not responsible for the acts or omissions of third-party suppliers (airlines, hotels, transport providers)
• Any medical costs, evacuation costs, or personal losses are your responsibility — travel insurance is mandatory

Nothing in these terms limits our liability for death or personal injury caused by our proven negligence, or for fraudulent misrepresentation.

We expect all travellers to respect the communities, environment, and fellow travellers they encounter:

• Treat local communities, guides, porters, and staff with dignity and respect
• Follow Leave No Trace principles — pack out all waste, do not damage wildlife or vegetation
• Dress modestly and respectfully in accordance with local cultural norms, especially in villages and religious sites
• Do not engage in illegal activities including drug use, poaching, or unauthorised photography of military installations
• Refrain from behaviour that disturbs other travellers or brings Roamistan into disrepute

The following are strictly prohibited:

• Harassment or abuse of any staff member, guide, or fellow traveller
• Consumption of alcohol in areas or communities where it is culturally or legally prohibited
• Abandoning the group in remote areas without guide consent
• Misrepresenting health conditions that affect your ability to participate safely

Roamistan reserves the right to remove any traveller who violates these conduct standards. No refund will be issued in such cases.

All content on roamistan.com — including text, photography, videos, logos, itineraries, and tour descriptions — is the exclusive property of Roamistan and is protected by applicable copyright law.

• You may not reproduce, distribute, or commercially use any of our content without prior written permission
• Photographs taken on our tours are for personal use only — commercial licensing requires written approval
• Our brand name 'Roamistan', logo, and related marks are registered trademarks and may not be used without authorisation

By submitting reviews, photographs, or testimonials to us, you grant Roamistan a non-exclusive, royalty-free licence to use this content in our marketing materials.

These Terms of Service shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.

In the event of any dispute arising from these terms or your use of our services, we encourage you to first contact us directly to seek an amicable resolution. If a dispute cannot be resolved informally within 30 days, it shall be referred to the courts of competent jurisdiction in Islamabad, Pakistan.

• Both parties agree to attempt mediation before pursuing formal legal proceedings
• The language of all proceedings shall be English or Urdu
• Nothing in these terms affects your statutory rights under Pakistani consumer protection laws
